As we all know, institutions are not perfect and peer review can be used as a lever to promote an institution's or an individuals agenda. When this happens, the line is crossed between good faith Peer Review and sham peer review. Frequently a physician cannot know in advance whether the peer review will be fair and unbiased or will be an attempt to sanction a physician for a myriad of improper reasons. For this reason we believe that every physician facing potential sanctions take these reviews very seriously and seek competent legal counsel as early as practical in the process. Certainly the hospitals will have sought the advice of their counsel prior to acting. Likewise it is prudent for a physician to seek consultation with a qualified expert in the laws and procedures in the state in which the practice is located. |
